Privacy Charter

Last updated: [Insert date]. Rise Migration Lawyers Pty Ltd (ABN 31 695 470 814) (“we”, “us”, “our”) is committed to protecting your privacy. This Privacy Charter explains how we handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. The information we collect

In the course of providing immigration legal services we may collect:

  • Identity and contact details — name, date of birth, address, email and phone number;
  • Immigration and personal history — passport and visa details, citizenship, relationship and family information, employment, qualifications and skills assessments;
  • Sensitive information relevant to a migration matter — such as health, character or biometric information, where it is reasonably necessary and you have consented or we are otherwise permitted to collect it;
  • Financial information — for the purpose of providing fee estimates and processing payments; and
  • Website and portal usage data — including information collected through cookies and analytics (see section 7).

2. How we collect it

We collect personal information directly from you wherever practicable — through our enquiry and consultation forms, email, telephone, in consultations, and via our secure client portal. In some cases we collect information from third parties (for example, sponsors, employers, or government agencies) where it is necessary for your matter and the law permits.

3. Why we collect and use it

We use your personal information to:

  • provide immigration legal advice and prepare, lodge and manage visa applications, appeals and related matters;
  • liaise with the Department of Home Affairs, the Administrative Review Tribunal, courts and other relevant bodies on your behalf;
  • respond to your enquiries and manage our client relationship, including billing;
  • meet our professional, legal and regulatory obligations.

4. Disclosure of your information

We may disclose your personal information to government agencies and tribunals as required to progress your matter, to third parties where you have consented, and to trusted service providers who assist us in operating our practice (for example, IT and document-storage providers) under confidentiality obligations. Some of these providers may store data outside Australia; where this occurs we take reasonable steps to ensure your information is handled consistently with the APPs. We do not sell your personal information.

5. Storage and security

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, including through secure systems, access controls and our encrypted client portal. We retain information for as long as necessary to provide our services and to meet our legal and professional record-keeping obligations, after which it is securely destroyed or de-identified.

6. Access and correction

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. To make a request, contact us using the details below. We will respond within a reasonable period and may need to verify your identity first. In limited circumstances we may decline access as permitted by law, and will explain why.

7. Cookies and website analytics

Our website uses cookies and analytics tools to understand how visitors use the site and to improve it. You can disable cookies in your browser settings, although some features may not function as intended. Analytics data is generally aggregated and does not identify you personally.

8. Complaints

If you believe we have breached the Australian Privacy Principles, please contact us first so we can investigate and respond. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
